This website is owned and operated by Helpha, LLC, a licensed health insurance agency. This website is not affiliated with the federal government or the Medicare program. Please read these Terms of Service (the "Agreement") carefully. Your use of the Site constitutes your legal consent to be bound by this Agreement including our Privacy Policy and Arbitration Agreement.

Welcome, and thank you for your interest in Helpha, LLC ("Us," "Our," or "We") and our websites, networks, applications, insurance agent and representative services, and communication channels (including online chat and telephone call centers), and other services provided by us (collectively, our "Service").

Important Disclosures:

Helpha, LLC represents Medicare Advantage HMO, PPO and PFFS organizations and stand-alone PDP prescription drug plans that have a Medicare contract. Enrollment depends on the plan's contract renewal.

Enrollment in a plan may be limited to certain times of the year unless you qualify for a Special Enrollment Period or you are in your Medicare Initial Enrollment Period.

We do not offer every plan available in your area. Currently we represent [XX] organizations which offer [XXX] products in your area. Please contact Medicare.gov, 1-800-MEDICARE, or your local State Health Insurance Program (SHIP) to get information on all of your options.

Not all plans offer all of these benefits. Benefits may vary by carrier and location. Limitations and exclusions may apply.

Medicare Supplement insurance is available to those age 65 and older enrolled in Medicare Parts A and B and in some states to those under age 65 eligible for Medicare due to disability, ALS (Amyotrophic Lateral Sclerosis also known as Lou Gehrig's disease), or End Stage Renal disease. Medicare Supplement plans are not connected with or endorsed by the U.S. government or federal Medicare program. The Centers for Medicare & Medicaid Services (CMS) does not review or approve Medicare Supplement plan information.

Medicare supplement plans cannot be held with Medicare Advantage plans.

This is a solicitation for insurance. If you are eligible for Medicare, a licensed sales agent may contact you to discuss Medicare plan options via phone or email. Submitting information will not impact your current Medicare enrollment, nor will it enroll you in any Medicare plan.

The plans we represent and their subsidiaries do not discriminate on the basis of race, color, national origin, age, disability, sex, sexual orientation, gender identity, or religion.

*THIS AGREEMENT CONTAINS AN AGREEMENT TO ARBITRATE ALL CLAIMS. EXCEPT IF YOU OPT-OUT, DISPUTES WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT.

1. Modification of Terms

We reserve the right to modify this Agreement from time to time without notification. Your use of the Services after such modification constitutes acceptance of those changes. You can determine when we last changed this Agreement by referring to the "LAST UPDATED" date above.

2. Your Access to and Use of the Services

Your access to and use of the Services may be interrupted due to technical malfunctions or repairs. We may, in our discretion and without notice, suspend or terminate your access if we believe your conduct violates this Agreement or third-party rights.

3. Information You Submit

You agree that all information you provide to us is true, accurate, and complete and that you will not misrepresent your identity or enter information on behalf of any third party.

4. Authorization to Contact

You understand and agree that by providing us with a telephone number and other contact information, you agree to receive communications, including via email, texts, and calls (including text messages and calls made using an autodialer or prerecorded voice message), from Helpha, LLC or on our behalf at the email address or telephone number you provided, even if that number is on a National or State Do Not Call List. Consent is not a condition of purchase.

Opt-Out: To opt out of marketing emails, follow the unsubscribe link. To opt out of texts, reply "STOP". To opt out of marketing calls, call (877) 466-8086 or email compliance@helphahealth.com.

5. Helpha is Not an Insurance Company

Helpha, LLC is a licensed health insurance agency and not an insurance company. The Services introduce users to insurance and related products offered by third parties.DO NOT CANCEL ANY EXISTING INSURANCE UNTIL YOU RECEIVE WRITTEN CONFIRMATION FROM THE INSURANCE COMPANY TO WHICH YOU ARE APPLYING THAT YOUR NEW POLICY IS IN EFFECT.

6. Rules of Conduct

  • You must be at least 18 years of age.
  • You must not use the Services for any illegal purpose.
  • You must not use any robot, spider, or "scraper" to gather Service content without Our express prior written consent.

7. DISCLAIMER OF WARRANTIES

WE PROVIDE THE SERVICES ON AN "AS IS" BASIS. Helpha, LLC DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

8. LIMITATION OF LIABILITY

IN NO EVENT WILL Helpha, LLC BE LIABLE FOR AN AMOUNT EXCEEDING $100.00.

9. Pre-Filing Notice and Good Faith Negotiation

The parties agree that before initiating any legal action, each party agrees to first provide written notice of the dispute to the other party (for Us at compliance@helphahealth.com). Each party agrees to engage in good faith efforts to resolve the dispute for a period of sixty (60) days.

10. ARBITRATION AGREEMENT

Any dispute arising out of the use of the Services shall be resolved by binding arbitration administered by JAMS. You and Helpha, LLC agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class or representative action.

11. Governing Law

This Agreement shall be governed by the laws of the State of Tennessee. All disputes shall be litigated exclusively in the state and federal courts residing in Davidson County.

12. Product Restrictions

Quotes provided are based on the information you have provided and are subject to change or underwriting qualification by the specific Carrier. A quote is not a commitment from a Carrier to issue a policy.

Electronic Communications; Text Messaging; Telephone Calls

Program Description: By agreeing, you are allowing Helpha to send you transactional/informational SMS communications regarding your existing account or upcoming appointments with a licensed professional.

Opt-Out: You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. Alternatively, you can visit https://www.helpha.com/dont-call-us to opt-out.

Costs and Frequency: Message and data rates may apply for any messages sent to you from us and to us from you. You will receive no more than one message per day. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
